Introduction
This Acceptable Use Policy ("AUP") outlines the acceptable use of services, equipment, and facilities provided by Savitele, LLC ("Carrier"). By using Carrier's services, the customer ("Customer") agrees to comply with this AUP, which aims to ensure the security, integrity, and reliability of Carrier’s network and services. Carrier reserves the right to amend this AUP at any time, and such changes will be effective upon posting on Carrier’s website.
1. Prohibited Uses
Customers may not use Carrier’s services to engage in any activity that is illegal, disruptive, or harmful. Prohibited uses include, but are not limited to:
1.1 Illegal Activities
Any activities that violate local, national, or international laws, including but not limited to fraud, identity theft, and distribution of child exploitation materials.1.2 Intellectual Property Infringement
Infringing upon the intellectual property rights of others, including copyrights, trademarks, patents, and trade secrets.1.3 Unlawful Access and Hacking
Attempting to gain unauthorized access to Carrier's network, accounts, or data of other Carrier customers or attempting to breach Carrier's security or authentication measures.1.4 Network Disruption
Engaging in activities that disrupt, damage, or interfere with Carrier’s network, including unauthorized monitoring, spamming, flooding, overloading, or deliberate attacks, such as Distributed Denial of Service (DDoS).1.5 Distribution of Malicious Software
The transmission or distribution of software viruses, malware, or any other harmful computer code or programs designed to interfere with the operation of networks or computers.1.6 Unsolicited Communications
Sending unsolicited bulk communications, including spam, phishing emails, or other deceptive or unwanted messages.
2. Usage Policies
2.1 Bandwidth and Resource Limitations
Customers must use Carrier's network resources efficiently and must not interfere with the use of services by other customers. Excessive use or misuse of bandwidth that degrades network performance is prohibited.2.2 Network Traffic Filtering
Carrier reserves the right to implement traffic filtering, management, and monitoring as needed to ensure network integrity and to prevent abuse.2.3 Network Interconnection Requirements
All interconnections with Carrier's network must comply with the technical requirements specified by Carrier and must not degrade service quality.
3. Security and Privacy
3.1 Customer Security Obligations
Customers are responsible for ensuring the security of their systems, applications, and data while connected to Carrier's network, including proper configuration and implementation of security measures.3.2 Reporting Security Incidents
Customers must immediately notify Carrier of any known or suspected security breaches, unauthorized access, or misuse of Carrier’s network or services.3.3 Privacy and Data Protection
Customers must comply with all applicable data protection and privacy laws and must not use Carrier's network to collect, store, or transmit personal data unlawfully.
4. Enforcement and Remedies
4.1 Monitoring and Investigation
Carrier reserves the right to monitor Customer’s use of services to ensure compliance with this AUP and to investigate any potential violations.4.2 Response to Violations
In response to any violation of this AUP, Carrier may, at its discretion and without prior notice:- Suspend or terminate services.
- Restrict or block access to parts of the network.
- Report the violation to relevant authorities.
- Take any other action deemed necessary to protect Carrier's network, services, and customers.
4.3 Indemnification
Customer agrees to indemnify and hold Carrier harmless from any claims, damages, or losses arising from Customer's violation of this AUP or misuse of Carrier's services.
5. Disclaimer
Carrier is not responsible for the content or information accessed, transmitted, or received through its services. Carrier disclaims all responsibility for damages or harm caused by Customer’s misuse of its network or any prohibited activity.
6. Amendments
Carrier reserves the right to modify this AUP at any time. Carrier will notify Customers of changes to the AUP via its website, and continued use of Carrier's services constitutes acceptance of the updated AUP.
